1. Acceptance of Terms

By accessing or using Monkey Commerce ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Monkey Commerce is a decentralized e-commerce platform where users can discover and purchase creator-designed streetwear and apparel. Payments are processed via the Solana blockchain using supported tokens including SOL, USDC, and BONK. Products are fulfilled through third-party print-on-demand and shipping partners.

3. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. You are also responsible for ensuring your use of the Service complies with all applicable laws in your jurisdiction.

4. Wallet Connection & Authentication

Access to certain features of the Service requires connecting a compatible Solana wallet (e.g., Phantom, Solflare). You are solely responsible for:

• Maintaining the security of your wallet, private keys, and seed phrases
• All activity that occurs through your connected wallet
• Ensuring sufficient funds in your wallet to complete transactions

We will never ask for your private keys or seed phrases. Never share these with anyone.

5. Orders & Payments

5.1 Placing Orders

When you place an order, you agree to provide accurate and complete shipping information. All orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order at our discretion.

5.2 Blockchain Payments

All payments are processed on the Solana blockchain. Once a transaction is confirmed on-chain, it is final and irreversible. You are responsible for verifying the transaction details before confirming in your wallet. Network fees (gas) are paid by the buyer and are non-refundable.

5.3 Pricing

Product prices are displayed in USD and can be viewed in equivalent token amounts (SOL, USDC, BONK). Token prices fluctuate based on market rates. The token amount required at the time of transaction confirmation is the final amount charged.

6. Products & Fulfillment

• Products are made-to-order through our print-on-demand fulfillment partners. Production and delivery times vary by product and destination.
• Product images are digital mockups and may vary slightly from the final printed product in terms of color and placement.
• We are not responsible for delays caused by fulfillment partners, shipping carriers, or customs processing.

7. Refunds & Returns

Due to the nature of print-on-demand products and blockchain-based payments:

• Refunds may be issued for defective or significantly misprinted products. You must contact us within 14 days of receiving your order with photographic evidence.
• Refunds, if approved, will be processed to the original wallet address used for payment, subject to current token exchange rates.
• We do not accept returns for change of mind, incorrect size selection, or buyer's remorse.
• Blockchain network fees are non-refundable under any circumstances.

8. Intellectual Property

All designs available on Monkey Commerce are created by independent creators. Creators retain ownership of their original designs. By purchasing a product, you receive a physical item featuring the design — this does not transfer intellectual property rights or grant a license to reproduce, distribute, or create derivative works.

The Monkey Commerce name, logo, and platform are proprietary. You may not use our branding without prior written consent.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to exploit, hack, or reverse engineer the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated systems (bots, scrapers) to access the Service
• Impersonate another person or misrepresent your identity
• Attempt to manipulate token prices or engage in market manipulation
• Use the Service to launder money or finance illegal activities

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for any losses resulting from blockchain network issues, wallet vulnerabilities, smart contract bugs, token price fluctuations, or other factors beyond our control.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Monkey Commerce and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or digital assets, arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Monkey Commerce, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operators of Monkey Commerce are established, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
